Landlord Guide

As a landlord you will have certain legal responsibilities, tax liability and many other letting considerations that you will need to take into account when letting your property. At John Grants we can advise you and organise for these to keep you compliant and to ensure that the letting of your property is as smoothly handled as possible. Remember we have the experience of over 20 years and the know how to advise you best.

No 1Consents

You will need the consent of your Lender (if you have a mortgage and it is not a Buy To Let mortgage) to let the property. If you have a leasehold property then you will also require the consent of your Freeholders (if this is not already part of your lease).

No 2Compliance

Compliance issues that you will need to consider when letting your property these include:

  • Gas Safety Regulations
  • Energy Performance Certificate
  • Furniture and Furnishing Regulations
  • Electrical Installation and Equipment Regulations
  • Smoke Detectors (mains operated) for all properties built after 1992
  • Section 11 of the Housing Act sets out Landlord Repairing Obligations which you will need to be aware of.

No 3Landlord Insurance

Ensure that you have the correct Buildings Insurance (and contents insurance) on your rented property Check the policy for the type of lettings it covers. Do not fall short and make sure you are covered. If you have a leasehold property you will normally find that your Freeholders insurance covers your for buildings insurance; but check this is the case.

No 4Letting Scheme

Decide on the type of letting scheme you wish to opt for. At John Grants we offer:

  • Let Only                  Introduce tenants only to the property.
  • Rent Collection       Let Only plus we will collect rent on your behalf.
  • Full Management    As well as the above we will fully manage the property on your behalf.
  • Guaranteed Rent    Your  monthly rent is guaranteed as well as managing the property on a 1 to 3 year leasing Scheme.

No 5Contracts and Legal Stuff

Tenancy Agreements There are different types of tenancies, the main one that you will be using will be an Assured Shorthold Tenancy (AST), as set out under the Housing Act 1988 (amended 1996).

While the law does not require for an AST to be written down it is important to ensure that a comprehensive tenancy agreement which sets out the terms of the agreement.

Tenancy Deposits (Bonds) Deposits taken after the 6th April 2007 must be protected within a Tenancy Deposit Scheme and Prescribed Information must be given to the tenants. At John Grants we are members of The Dispute Service (TDS).
Notices You may need to Serve Notice on your tenant either to end the tenancy or to rectify any breach of contract. It is important that these are served correctly and as set out under the Housing Act.

No 6Inventory and Schedule of Condition Report

John Grants will, on your behalf, instruct a third party to carry out an Inventory and Schedule of Condition Report at the beginning of a tenancy.

This will detail the condition of the property, fixtures and fittings and any furniture. If a claim is to be made against the deposit then you will have a point of reference to rely on – otherwise it may prove difficult to claim against the deposit.

No 7Preparation

The successful letting of your property and finding suitable tenants will depend on your preparation of the property. Here are a few tips to ensure the property is let minimising any void periods and to a suitable tenant.

  • Preparation – ensure that any repairs are carried out.
  • Professional Cleaning – doing this at the beginning of all tenancies sets the standard for all future rentals.
  • De-Clutter – remove any unwanted items, clear out any shed or lofts.
  • First impression – this will always count in letting your property.

No 8Rental Valuation, Marketing, Viewings & Offers

Rental Value is where it begins – Under & Over valuing your property will ultimately mean loosing money on your investment. John Grants property consultants are backed by over 20 years experience and up to date knowledge of the local market.

John Grants will present your property to a wide audience through our various advertisements, prime located office and web portal advertisements. All viewings will be escorted by our experienced property consultants allowing us to answer all questions raised by prospective tenants and give you our Landlord informed feed back.

To ensure that we are able successfully market the property we suggest that you:

  • Provide a set of keys
  • Allow us good access to the property
  • Allow our trained staff to conduct the viewings
  • Any offers received from interested tenants will be put forward to you with an informed position about the prospective tenants – we will only take a holding deposit at your agreement that you are happy for us to proceed. All offers and deposits are taken subject to contract and successful referencing of the tenants.

No 9Tenant Referencing

Our stringent referencing criteria allows for John Grants to select the right tenants for your property. An external referencing company will normally be used to carry out the necessary credit checks and verify information provided by prospective tenants.
